Our Brand Promise We uniquely provide a home or building owner a 10-Year Waterproofing Warranty Certificate coverage backed by a reputable national insurance agency, which includes labor and material coverage in the rare case something goes wrong. This coverage is specifically for the exterior residential and commercial building waterproofing systems on the foundations that we protect daily.
How Does it Work?
Once your Hulk waterproofing system has been installed and receives the builder and applicator’s completion status, you contact Hulks customer service to register your warranty. Simple. We take it from there; we ensure the contractors/applicators have completed all the quality control and assurance procedures and register your warranty certificate immediately. We always reserve the right to inspect the craftmanship after installing the waterproofing protection. This does not delay your warranty certificate. We sometimes conduct random inspections to ensure our quality standards have been achieved.
Your Specific Warranty Coverage
Hulk Systems warranted to the property owner and approved by the builder, contractor/applicator that the exterior waterproofing foundation membrane has been installed free of defects and will provide superior water infiltration protection. We confirm that a trained Hulk System contractor/applicator applied the material aligned with our application specifications and quality control procedures.
Hassel Free Approach
Suppose this product fails to perform. You are protected. After we are notified, within 72 hours, that there is a problem with the foundation waterproofing protection, we will immediately have a field technician inspect the foundation. After the assessment, we will quickly replace the exterior waterproofing membrane if it is determined that the product is defective, or the applicator misapplied the waterproofing membrane. This is very rare, yet we are prepared to act swiftly if there is a problem.
Coverage Practicality
We cover what we are responsible for. The Hulk Systems warranty shall not be liable for any incidental, consequential, or uncommon damages of any form during the warranty period. This includes damage to the interior or exterior of any building or replacement not authorized in writing or performed by the Hulk Systems contractors/installers. This includes any touch-ups and minor repairs that may have occurred after the initial application. The home or building owner is responsible for damage, including minor touch up and repairs caused by themselves or other parties after the installation date.
The Hulk warranty is not connected to any other 3rd party trade warranties the homeowner or builder may have received from any construction material suppliers.
Hulk Systems is not responsible for any warranty or guarantee on the surface substrate, premises, or structure to which the coating materials were applied, nor does it guarantee the structural integrity or proper construction of the building itself. Hulk Systems will not be liable for substrates or structural damage such as foundation cracking caused by settling, pre-existing damage to the substrate that was not repaired at the time of installation, damage resulting from human error, foreign objects, vermin, chemical exposure, ponding water or submersion due to improper drainage and grading, plumbing leaks, improper window or walkout installations, building movement, design defects, or equipment defects caused by added structure penetrations or the installation of mechanical or otherwise units such as window wells, mounted air handlers, vents, stacks, or other units installed before or after the Hulk Systems waterproofing foundation protection system was applied. Hulk Systems does not warrant damages caused by abrupt impact, abrasion, or abuses caused by machinery, equipment, vehicles, 3rd party trades, or installation of items such as decks and posts in which the construction interferes with the warranted coating system.
Effective Date
This warranty is effective as of the below listed Date of Issue for Hulk Systems products installed within the United States, Canada, and all other regions Hulk Systems products are installed.
Transferability
The warranty certificate may be transferred in writing during the ten years of coverage to the first subsequent owner of the home or building. The membrane was installed on the condition that Hulk Systems receives notice of transfer by registered mail (Attention: Warranty Transfers, C/O Hulk Systems ADDRESS – 4209 Brandon Street SE, Calgary, AB, T2G4A7) from the previous owner. This should be done within 15 days of taking ownership of the home or building. We will require proof of ownership.
Limitations
LIMITATION OF DAMAGES; MEDIATION; JURISDICTION THIS WARRANTY IS EXPRESSLY in place of ANY OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, and of any other obligations or liability of Hulk Systems, whether any claim against it is based upon negligence, breach of Warranty, or any other theory. In NO event shall Hulk Systems be liable for any CONSEQUENTIAL OR INCIDENTAL DAMAGES of any kind, including, but not limited to, interior or exterior damages and mold remediation. As the holder of the Hulk Systems ten-year warranty certificate, it is acknowledged and understood that the specific terms and conditions of the waterproofing membrane warranty are entirely acceptable.
